Terms and conditions

Terms copied from an EU site apply a law that is not yours.

Swiss law has no general right of withdrawal for online purchases, and its warranty for defects follows its own time limits. Adopting European terms imposes obligations the law does not require of you, and misses the ones it does.

  • Deadline guaranteed or refunded
  • 2 rounds of corrections included
  • 12 months of follow-up advice included
  • Secure Stripe payment

Understand

The four points where Switzerland differs.

Is there a right of withdrawal online?

No, Swiss law gives no general right of return for an internet purchase. The seven-day right of revocation covers doorstep and telephone selling, not online sales. Many merchants grant one as a commercial choice: it then becomes a contractual promise, and binds you as such.

Art. 40a et seq. CO

How long does the warranty for defects last?

Two years from delivery, five years for immovable works, and the buyer must give notice immediately on discovery. Between businesses the warranty may be reduced or excluded, save for fraud. Against a consumer, a period shorter than two years on a new item cannot be relied upon.

Art. 201, 210 CO

May I choose the jurisdiction and governing law?

Between businesses, yes, and it is one of the most useful clauses. Against a consumer, no: they may always sue at their domicile, and a contrary jurisdiction clause does not bind them. We draft both cases rather than one unenforceable clause.

Art. 32 and 114 PILA, art. 35 CPC

Must prices be displayed including VAT?

Yes, towards consumers: the price shown is the price payable, taxes and levies included, with no surcharge discovered at checkout. The Price Indication Ordinance requires it, and breach falls under unfair competition.

Art. 3 and 4 PIO, art. 3 UCA

FAQ

Questions about the terms

How do my terms become binding?

The customer must have been able to read them before ordering and have accepted them, in practice through an unticked checkbox with a direct link. An unusual and unfavourable clause buried in the text may be set aside even where the terms were accepted.

What if I also sell in the European Union?

The version for EU customers is included: it adds the fourteen-day right of withdrawal and the required information. You get two coherent sets rather than a hybrid text satisfying neither.

Do subscriptions need separate terms?

Yes, renewal, termination, price changes and what happens to data at the end of the contract are specific to subscriptions. Tell us: the text changes, the price does not.

Are they delivered ready to publish?

Yes, as clean HTML to paste into your page, alongside Word and PDF. If your site runs on a known platform, we indicate where to place them and how to link them into the checkout.

Do they cover data protection?

The terms refer to the privacy policy, a separate document required by the revised Data Protection Act. Website compliance covers it, together with the register of processing activities.
