Module · Compliant website

A Swiss website must follow Swiss law, not a copy-pasted GDPR.

Most Swiss websites display a European privacy policy and foreign terms. They cite laws that do not apply and forget those that do. Clairdex generates the texts required by the FADP and the Unfair Competition Act, and warns you when the law changes.

Who it is forOnline shops, company websites, web agencies delivering sites to Swiss clients, online service providers.

What the module produces

The mandatory texts, and those your customers expect.

Legal notice

Identity, address and contact of the operator, required for any online offer by the Unfair Competition Act. With the UID and VAT number if you are registered.

FADP privacy policy

What the Federal Act on Data Protection requires you to disclose: purposes, recipients, transfers abroad, rights of the persons concerned, contact. Without needless GDPR references, or with them if you also sell in the European Union.

General terms of sale

Formation of the contract, price and VAT, delivery in Switzerland and abroad, warranty, optional withdrawal, retention of title, jurisdiction and applicable law. The terms and conditions are ordered per item.

Cookies and analytics

The information required in Switzerland on cookies and analytics tools, and what changes if you also target European visitors.

Price display

Prices including VAT, ancillary costs, comparison prices and promotions under the Price Disclosure Ordinance, the rule Swiss shops break most often.

Change monitoring

When an act or ordinance changes, you receive an alert with the clause to update. Entreprise and Cabinet plans.

The thirty-second test

Is your website Swiss, or just in a Swiss language?

Signs of a text copied from Europe

  • Privacy policy citing the GDPR and never the FADP
  • 14-day right of withdrawal presented as mandatory
  • Terms naming a French or German court
  • European cookie banner with no Swiss information
  • Prices shown excluding VAT or without shipping

What Clairdex generates

  • Policy based on the revised FADP, in force since September 2023
  • Withdrawal treated as an explained commercial choice
  • Swiss jurisdiction and law, adapted to your seat
  • Cookie information compliant with Swiss law, extendable to the GDPR
  • Price display compliant with the ordinance

Examples

What Swiss law requires of a website.

What information must my website display?

For any online offer: your full identity, your contact address and an email address, the technical steps of the order, the means to correct input errors and an order confirmation. Their absence is an act of unfair competition.

Art. 3 para. 1 let. s UCA

Must my shop inform before collecting data?

Yes. Since 1 September 2023, any collection of personal data must be announced: identity of the controller, purposes, recipients, and destination country in case of transfer abroad. The privacy policy is the usual means.

Art. 19 FADP

What happens in case of a data security breach?

A breach presenting a high risk must be reported to the Federal Commissioner as soon as possible, and to the persons concerned if their protection requires it. Clairdex guides you through the report and prepares the communication.

Art. 24 FADP

FAQ

Questions about website compliance

I also sell in France and Germany. What should I do?

Clairdex generates a version that complies with Swiss law and adds what the GDPR and European consumer law require in addition, for instance the fourteen-day right of withdrawal for those customers. You choose the target markets, the texts adapt.

Can an agency generate the texts for its clients?

Yes, that is what the Cabinet plan is for: one file per client, texts under the agency's brand, and an alert when a law changes for all delivered sites. Before taking on a new client, the verification file tells you whether they will pay.

Is a cookie banner required in Switzerland?

Swiss law requires information, not prior consent for most cookies. Consent becomes necessary depending on the use and if you target European visitors. Clairdex tells you what applies to your case and generates the text.
